1. Acceptance of Terms

By accessing or using CareBaton ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, including caregivers, family members, and care recipients.

The Service is operated by Blended Software, LLC doing business as CareBaton ("Company," "we," "us," or "our"). References to "CareBaton" throughout these Terms refer to Blended Software, LLC d/b/a CareBaton.

2. Description of Service

CareBaton is a care coordination platform that helps families and caregivers manage medication reminders, wellness check-ins, appointments, and care tasks for aging adults. The Service is provided as a subscription-based software application accessible via the web and mobile devices.

3. Accounts and Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must be at least 18 years old to create an account.
  • You are responsible for all activity that occurs under your account.
  • Notify us immediately at [email protected] if you suspect unauthorized access.

4. Subscriptions and Billing

CareBaton is offered on a subscription basis. By subscribing:

  • You authorize us to charge your payment method on a recurring basis.
  • Subscriptions automatically renew unless cancelled before the renewal date.
  • You may cancel at any time through your account settings or by contacting support.
  • Refunds are handled at our discretion; contact [email protected] for refund requests.
  • We reserve the right to change subscription prices with 30 days' notice.

Payment processing is handled by our third-party payment processor. We do not store your full credit card number. By subscribing, you also agree to the payment processor's terms of service.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload or transmit malicious code or interfere with the Service
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service to harass, abuse, or harm others
  • Resell or commercially exploit the Service without our written permission
  • Misrepresent your identity or impersonate any person

6. Medical Disclaimer

CareBaton is a care coordination and reminder tool, not a medical service. The Service does not provide medical advice, diagnosis, or treatment. Medication reminders and health check-ins are organizational aids only.

Do not rely on CareBaton as a substitute for professional medical care. Always consult a qualified healthcare provider for medical advice. In case of a medical emergency, call 911 or your local emergency services immediately.

7. User Content

You retain ownership of content you submit to the Service (notes, medication information, etc.). By submitting content, you grant us a limited license to store and process it solely to provide the Service to you. We do not use your care data for advertising or share it with third parties except as described in our Privacy Policy.

8. Service Availability

We aim to keep CareBaton available at all times but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience outages. We are not liable for any loss or inconvenience caused by service interruptions.

Because CareBaton delivers time-sensitive reminders, you should maintain alternative reminder systems and not rely solely on CareBaton for critical medication adherence.

9. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time by contacting us. Upon termination, your access to the Service will cease and we may delete your data in accordance with our data retention policies.

10. Limitation of Liability

To the maximum extent permitted by law, CareBaton and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to missed medication reminders, data loss, or service interruptions.

Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

12. Indemnification

You agree to indemnify, defend, and hold harmless Blended Software, LLC d/b/a CareBaton, its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or inability to use the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any content you submit to the Service.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising out of or relating to these Terms or the Service shall be resolved in a court of competent jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
